E-Signature Policy

This E-Signature Policy ("Policy") describes how Malco Enterprises of Nevada, Inc. dba Budget Car and Truck Rental ("Budget Las Vegas," "we," "us" or "our") handles electronic signatures and records in connection with your use of our vehicle inspection application (the "Service"). Please read this policy carefully.
1. Consent to Electronic Signatures and Records
By checking the acceptance box (or similar consent mechanism) and proceeding with any inspection submission or agreement through the Service, you affirmatively consent to use electronic signatures and to receive and be bound by records and disclosures provided to you electronically in connection with the Service. This consent applies to all interactions and transactions made through the Service.
2. Scope of Consent
Your consent to electronic signatures and records applies to all documents, agreements, notices, disclosures, and other communications that we provide to you electronically in relation to your vehicle inspection. This may include, but is not limited to, inspection reports, consent forms, acknowledgments, and any updates to our terms or policies.
3. Option for Paper Records
You have the right to request paper copies of any electronic records. If you wish to obtain a paper copy, please contact us at the email address provided below. A nominal fee may be charged to cover the cost of providing paper copies. We will inform you of any applicable fees at the time of your request. Requesting paper copies does not withdraw your overall consent to use electronic records and signatures for future transactions unless you explicitly withdraw consent as described below.
4. Withdrawal of Consent
You have the right to withdraw your consent to receive electronic records and use electronic signatures at any time. To withdraw your consent, please contact us at the email address provided below. Please note that withdrawing your consent may result in your inability to use some or all features of the Service. If you withdraw consent, the legal validity and enforceability of prior electronic records and signatures will not be affected. We will confirm your withdrawal of consent and its effective date in writing (which may be electronic).
5. Hardware and Software Requirements
To access, view, and retain electronic records provided through the Service, you will need the following:
- A computing device (such as a desktop, laptop, tablet, or smartphone) with an internet connection.
- A current version of a widely used web browser (e.g., Chrome, Firefox, Safari, Edge).
- Software capable of viewing PDF documents (such as Adobe Acrobat Reader or a similar program).
- Sufficient storage space on your device or an email account to retain copies of electronic records.
6. Affirmative Consent & Signature
Your action of checking an acceptance box, clicking a button indicating "I Agree," "Submit," or similar phrasing, or otherwise providing an electronic instruction or acknowledgment through the Service, constitutes your electronic signature and demonstrates your intent to be bound by the terms of the relevant document or transaction, just as if you had signed a paper document with a pen. You agree that your electronic signature is the legal equivalent of your manual/ink signature.
7. Maintaining Accurate Contact Information
It is your responsibility to ensure that we have your current and accurate email address and other contact information so that we can communicate with you electronically. If our attempts to send electronic communications are unsuccessful because you have provided incorrect contact information or your email service is not functioning, we will be deemed to have provided the communication to you as long as it was sent to the last contact information you provided.
Governing Law
Any claim or dispute arising from or related to this E-Signature Policy of whatever kind, whether contractual or tort-based in nature, shall be governed by and construed in accordance with the laws of the State of Nevada, USA, without giving effect to any choice of law or conflict of law provision or rule.
Mediation
Prior to instigating arbitration of any dispute arising under the terms of this agreement the parties shall be required to participate in good faith mediation. Mediation shall be conducted at Advanced Resolution Management, 6980 S. Cimarron Road Ste, 210, Las Vegas, Nevada 89113 ("ARM"). Each party to the mediation will pay their portion of the mediation expense.
Arbitration
If the parties are unable to successfully resolve their dispute at mediation, then they shall submit their dispute to binding arbitration at ARM. If the parties cannot agree to an arbitrator, then their dispute will be tried before a three-arbitrator panel at ARM. Each party will select an arbitrator of their choosing; the two arbitrators will select the third arbitrator. The arbitration will be conducted in accordance with the Nevada Revised Statutes, Nevada Rules of Evidence, Nevada Rules of Civil Procedure, and Eighth Judicial District Court's Local Rules. Each party to the arbitration will pay their portion of the arbitration expense. The prevailing party shall be entitled to reasonable attorney fees and costs.
